Arrest & Inprisonment
1.1 – Police Caution
Prior to Police interviewing you or questioning you in relation to a crime or other matter they must first read you a caution which advises you of your rights as a resident of Aurora and the privileges you are afforded.
The right to remain silent
Right to legal representation
Right to make a phone call to an family member or friend to notify of them of your whereabouts
1.2 – Right to Legal Representation and Court
When pleading not guilty the defendant or suspect is provided with the right to legal representation and access to a fair courts system.
The Police must allow you to make a supervised phone call to a lawyer and must provide notice to the Court to determine if a judge is available. A wait time of 30 minutes is allocated for a response from Aurora City Court to advise if a judge is available or not. if no judge is available at the time or if the hearing is to take place on a later date you will be sentenced and jailed accordingly with a chance to appear at that Court hearing.
The Police officer making the arrest must acknowledge and confirm a request has been made if requested. All time spent in the holding cells is to be calculated and included as time served towards the total sentence.
All time served in prison for a offence if later found to be unjust will be compensated at a standard rate of $4000 per 1 month of imprisonment, this will be funded directly by the Police.
