4.1 – Unfair dismissal
4.1a
Employees need to apply to the courts within 7 days of the dismissal taking effect. The 7 day period starts the day after the dismissal.
4.1b
Employees need to be employed for at least 5 days before they can apply for unfair dismissal. If you have been employed for less than 5 days you will be considered to be in your probationary period and thus be ineligible to apply for unfair dismissal.
4.1c
Employers are required to provide notice of termination prior to any formal acts of termination such as removing job roles in city or removing job roles in the business emails or restricting the employee from standard work arrangements.
4.1d
Notice of termination must be provided in writing via either a in city email, text message or a out of city email. Employers must document this and must provide evidence/proof if requested by the courts.
4.1e
A individual voids all employment rights including rights to a lawful dismissal if the grounds for dismissal relate directly to a government matter as any dismissals that directly relate to either the in city rules or community guidelines puts the case in the jurisdiction of the Aurora City Government and is handled outside of the courts system.
4.2 – Termination
4.2a
A employer reserves the right to terminate a employee if the employee is found to have;
Committed a crime or unlawful act as per the constitution
Been a party to or accessory to a crime or unlawful act helping to carry it out even in-directly
Not abided by the employment contract if one was provided
All employment contracts will be voided if the employer has not obtained written acceptance of the contract from the employee. Management of a business's contracts with it's employees is the sole responsibility of the business.
4.2b Terminations are immediately in effect and the business reserves the right to remove the employee's usual work access or assets that the business owns that were given to the employee for the purpose of carrying out their work. The employee must return all assets within 1 business day or risk being charged for theft.
4.2c
As mentioned in 4.1a the employee has 7 days to file a complaint to the courts and likewise the business also has 7 days to file a case against the employee for all related matters regarding the termination. Aurora City Court will not accept new cases in relation to matters that have lapsed this window or timeframe.
