Police Interactions
This document will outline the standards that you can expect from the Police during interactions with them and to educate you on your rights as a citizen to ensure fair and proper legal processes are followed. Police have the authority to conduct traffic stops, spot checks and searches under specific conditions but knowing the extent and limitations of these powers can significantly impact the outcomes of such interactions.
We encourage you to engage with legal professionals (accredited lawyers) should you have any concerns or doubts regarding the law and it's due processes.
All residents of Aurora City are afforded the right to remain silent and do not have to say or do anything that may incriminate themselves.
Prior to conducting a interview or statement with Police you have the right to request to speak to a lawyer before answering any questions or discussing any incidents such as the crime you are being implicated in or suspected of.
5.1 – Article I
If you are arrested you will be placed in a holding cell pending sentencing.
The arresting officer will process your case and must provide you with information as to why you have been arrested and your charges.
This includes;
Charges
Your expected jail time
Plea deals from the Police with a offers of clemency and reduced jail time depending on your cooperation, attitude and your stance to plead guilty or not guilty.
Based on the severity of the alleged crime and charges the Police may also elect not to engage in a plea deal or hold a interview.
If you decide to plea not guilty and contest your charges the Police must attempt to contact a Judge of the court through the dedicated channel in the DOJ emails. There will then be a waiting period of 30 minutes for a Judge to pickup the case. If there is no available Magistrates or Judges to take the case on the suspect will be sentenced and sent to jail with a chance to appeal the charges and sentence at a later date.
Time spent in the Police holdings cells is to be factored into the overall sentence and must be applied as time served.
The courts will ensure all winning defendants are compensated if they were wrongfully incarcerated.
For detailed information regarding the courts process please see the relevant document explaining the entire Aurora City Courts system.
5.2 – Article II
During a interaction with Police,
Police must identify themselves as Police by either;
Turning on their flashing red & blue emergency lights
Verbal indication of their name & rank (optional: their division or unit)
Show their official Gov issued ID Police badge
Police may elect to identify themselves via any one of the above methods as required by law.
The officer conducting the interaction must then advise you the reason for the interaction.
Police may conduct a search of your persons and your vehicle if;
You consent to the search
If there is reasonable suspicion that you may possess illegal firearms, drugs or other illegal items
Your vehicle is flagged or has been reported to be involved in a crime
If you match the description of a suspect the Police are currently looking for
If you are believed to have committed or been a related party to a crime
If you repeatedly refuse to obey instructions as directed by the Police this will be considered grounds for escalation and a declaration of non lethal or lethal force may be used at the officer's discretion to ensure compliance.
If you openly draw or am carrying any firearms or weapons while interacting with Police you will be considered a immediate hostile threat and no declaration will be required to engage you.
The Police are authorised to take from you and confiscate any illegal items however cannot take from you any clean money or legal items that are not explicitly considered illegal items as defined by Gov.
All confiscated items are held in a secure Police facility and may be returned only if the courts permits via a Court Order. Under no other circumstance are items to be returned or moved out of evidence.
If you believe that you have been wrongfully treated or have a complaint against the Police or a individual officer you may lodge a complaint via the Police Minister's office. All complaints with the exception of rule breaks or breaches of the community guidelines must stay in city and not brought to out of city channels.
We strongly advise that you consult a lawyer if you are unsure of any of the above processes as all cases will only be heard once and will not be reviewed again upon a judge making a decision on the matter.
