Introduction
These laws are enforced and applies to all citizens of Aurora City. In recognition of shared values of justice, democracy and fairness this constitution acts as the supreme legal framework on which all citizens, government officials, businesses, police and other government departments fall under.
The judiciary or courts interprets laws applies them to cases and settles disputes acting as an independent branch of government to ensure fair and impartial justice.
Terms
AC - Aurora City
1.1 – Separation of Powers
AC Supreme Court - Interprets applies and reviews laws with final authority over all legal disputes civil and criminal.
AC Gov Staff - Enforces city laws, city rules and the community guidelines. Has power to remove citizens via a flight.
AC Gov Departments - Enforces laws through government departments and provides services such as medical and fire rescue. These are classed as whitelisted jobs.
AC Magistrates Court - Consists of public/civil servants that operate in the same manner as the supreme court and is where most public day to day cases will originate and preliminary hearings heard. For a case to be escalated or brought before the Supreme Court a appeal or request application must be completed and approved.
1.2 – Legislative Authority
1.2a – Enactment of Laws
The government may propose, debate and pass laws/make amendments to this constitution in line with public interest.
All major changes will only be passed through a community poll requiring the majority vote to pass.
The government shall announce all major changes ahead of time and allow adequate time for the public to respond and participate in the poll.
All laws are subject to mandatory review by the Supreme Court if challenged.
All citizens flying into the city agree that are subject to and acknowledge that they understand and will act in accordance with the laws set out.
The Aurora City Government has powers to pass law and you will be considered to be under those laws at all given times.
1.2b – Court Summons
Upon being served a court summons, the summons obligates the individual to attend the court hearing at the specified location and time. If unavailable all parties are under obligation to write to a Judge or schedule a appointment at the front desk at the City Hall to request another date. Any amendments will only be considered to be in effect upon receiving official confirmation from a Judge.
Failing to appear in court after receiving a summons can lead to serious consequences, including a bench warrant for arrest, additional charges, and you can be potentially charged in absence. It's crucial to act promptly if you miss a scheduled appearance to minimise legal ramifications.
1.3 – Civil and Legal Rights
Fundamental Rights The laws of Aurora City serves a purpose to uphold and ensure:
Presumption of innocence until proven guilty.
Right to remain silent.
Right to legal representation through accredited lawyers.
Right to a fair and timely trial before an impartial court.
Right to appeal any criminal conviction or administrative penalty.
Note these rights do not apply to rule or community guideline breaches. All incidents related to either Rule Breaks or Breaches of the Community Guidelines will be escalated to Gov Staff and then the Supreme Court if legal attention is required.
